TERMS AND CONDITIONS

By using the site PTACUnits.com or by purchasing any products from PTACUnits.com, you are affirming that you accept and agree to be bound by the Terms and Conditions herein (“Terms”). Any reference to or mention of PTACUnits.com expressly includes PTAC Units, and vice versa. Any reference to a PTAC unit expressly includes and applies to all products sold on PTACUnits.com.

PRODUCT WARNING REGARDING HCFC-22

Customers buying refurbished units from PTACUnits.com take note: some refurbished units contain HCFC-22 (CHF2Cl) Monochlorodifluoromethane. This substance harms public health and the environment by destroying ozone in the upper atmosphere. Contact the manufacturer for further details.

Recording Customer Phone Calls

Our goal is to provide you with premium customer service at all times. To ensure that we reach that goal, we must be able to record and monitor any phone calls with our customer service team. That policy helps us make sure that we’re always giving you service of the utmost quality. Therefore, you explicitly authorize PTACUnits.com to record and monitor your phone calls with any of its agents or representatives.

Cancelling Orders

You understand and agree that PTACUnits.com’s order system submits your order automatically to the PTACUnits.com warehouse for picking, packing, and shipping. You understand that this means that you will not be able to cancel any order once it has been placed. Furthermore, you understand that PTACUnits.com may cancel any order at any time if you have failed to abide by these Terms. If PTACUnits.com does cancel your order due to a violation of these Terms, PTACUnits.com will supply you with a refund of the amount of your purchase minus a cancellation fee of $40 or 10% of your total purchase amount, whichever is the greater number. You also understand that if you refuse to accept delivery of any order that you placed, then PTACUnits.com will charge you for the full cost of shipping plus an additional restocking fee of 20% of the value of your order. In this instance, the “full cost of shipping” refers to the cost of shipping from PTACUnits.com’s warehouse to your shipping address, plus the cost of shipping back to the warehouse (which will be the same amount of the initial shipment to your shipping address). You will then receive the balance of your original payment as a store credit, not as a refund.

Shipping

You fully understand and agree that as soon as your order has been given to the shipping carrier, PTACUnits.com no longer has any control over your order. You agree that as soon as such shipping carrier delivers your order to your shipping address, you assume full responsibility for the order.

Warranties and Disclaimers

In the case of factory-new PTAC units, you fully understand and agree that PTACUnits.com does not offer any warranties, express or implied, and cannot be held liable for any claims and/or damages, or for the breach of any warranty, express or implied, whether of merchantability or fitness for any purpose whatsoever. In the case of refurbished PTAC units, PTACUnits.com provides a non-assignable six-month limited warranty. If, during the first six months after your purchase from PTACUnits.com, you discover that your refurbished unit is damaged or is not in good working order, you may submit a claim to us for determination of whether the issue is covered by this limited warranty. In order for us to process your claim, you must (1) provide us with your unit’s identification number, and (2) answer a series of questions. We reserve exclusive and sole discretion to deny your warranty claim for any reason, including but not limited to, your negligence, your fraud, or your ineligibility for the limited warranty. Note that this warranty only applies to defective or damaged goods, and it will not cover cosmetic issues such as dents, scratches, corrosion, or paint flaking. Also, this warranty only applies to units in the possession of our customer; this warranty does not apply to units that have been transferred by our customer to another party. OTHER THAN THESE EXPRESS WARRANTIES, PTACUnits.com MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THIS WEBSITE, ITS CONTENTS, ITS SERVICES, OR PRODUCTS ORDERED FROM PTACUnits.com. WE HEREBY EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO YOUR USE OF THIS WEBSITE INCLUDING ANY PRODUCTS OR SERVICES PROVIDED THROUGH THE SITE OR WHICH YOU PURCHASE THROUGH PTACUnits.com.

Your Release of Liability and Indemnification Obligations

You understand and acknowledge that the website PTACUnits.com is offered “as is”, with all faults, and PTACUnits.com makes no representations or warranties of any kind, explicit or implicit, related to PTACUnits.com, the materials contained on the website, or communications made by our agents or representatives. No guarantees are made that the listed equipment is suitable for a particular application or that the equipment will perform in accordance with the manufacturer’s specifications in your circumstances. The selection of proper heating and air conditioning equipment involves highly technical considerations that should be discussed with a qualified engineer or HVAC contractor. PTACUnits.com disclaims any liability due to your reliance on the information published on its website or communicated by its agents or representatives.

Nothing contained on PTACUnits.com may be construed as providing you with consultation or advice. Thus, PTACUnits.com expressly disclaims any and all liability for the accuracy of any information provided to you by PTACUnits.com, and for how you use any information provided to you by the same. You understand and acknowledge that PTACUnits.com cannot be held liable for how you or anyone else uses any information you receive from PTACUnits.com. Therefore, you explicitly agree to release, hold harmless, indemnify, and pay to defend PTACUnits.com and its owners, agents, officers, and employees against any resulting claims, actions, damages, costs, fines, investigations, assessments, and expenses (including reasonable attorney’s fees) and/or civil liability or criminal prosecution arising from or related to your use of the site and/or any information provided by PTACUnits.com, including all information on the website PTACUnits.com.

Additionally, you also fully understand and agree that by placing an order with PTACUnits.com, you alone are responsible for how the products you purchased from PTACUnits.com are used by you and any other party. You explicitly agree to release, hold harmless, indemnify, and pay to defend PTACUnits.com, its owners, officers, employees, and agents, against any and all civil or criminal claims, claims, actions, damages, costs, fines, investigations, assessments, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to the products you have purchased. If another party files a claim of any kind against PTACUnits.com related to your purchase or use of products you ordered from PTACUnits.com, you explicitly agree to release, hold harmless, indemnify and pay to defend PTACUnits.com, its owners, officers, employees, and agents, against any and all civil or criminal claims, claims, actions, damages, costs, fines, investigations, assessments, liabilities, and expenses (including reasonable attorney’s fees).

Limitation of Liability

You fully understand and agree that PTACUnits.com’s maximum liability to you shall in no event exceed the order price of your transaction with PTACUnits.com. You know that you are purchasing refurbished units on the resale market to benefit from a more affordable price; in exchange, you accept the risks of obtaining and using less-than-new units. You further acknowledge that PTACUnits.com is not an insurer and in the case that you experience damage or loss as a result of the products you acquire from PTACUnits.com, our liability shall be limited and capped at the selling price of the products you purchased, and this liability shall be exclusive. If you would like us to take on greater liability, you may reach out to us and we would be open to considering alternative terms.

Payment and Security Interest

Unless otherwise agreed to by PTACUnits.com, payment must be received before your order ships. If PTACUnits.com agrees to allow you to make payment after shipment of your order, then payment shall be due as indicated on your invoice. You agree that your payment is secured by the goods you purchase from PTACUnits.com, and you therefore grant us a security interest pursuant to the Uniform Commercial Code in those goods, until you make full and complete payment. You further grant us the right to file, in our sole discretion, any UCC-1 financing statement or other legal documents required to perfect our security interest. The foregoing security interest will be released and terminated upon your full and complete payment of all amounts owed. PTACUnits.com reserves the right to charge two percent (2%) to any outstanding invoices at the end of each month, or the maximum allowable legal interest rate, if a lesser amount.

Jurisdiction

Should you choose to file a complaint against PTACUnits.com or any of its owners, agents, officers, or employees, you agree that such a complaint must be filed within a court located in Knox County, Tennessee. You agree that any complaints filed within any other jurisdiction must be immediately removed to a court within Knox County, Tennessee. If PTACUnits.com is forced to institute legal proceedings to enforce these Terms and Conditions and PTACUnits.com prevails in such proceeding, then you are liable for attorneys fees and costs reasonably incurred by PTACUnits.com.

Governing Law

You understand and acknowledge that Tennessee law will govern, regardless of any conflicts of law principles, your use of the website PTACUnits.com and your purchase of any products thereon, any information or products you receive from PTACUnits.com, and any legal action initiated against you by PTACUnits.com. This applies equally to any legal action that you initiate, or that someone else institutes as a result of your actions, against PTACUnits.com.

Class Action Waiver

You understand and agree that any dispute resolution proceedings, including but not limited to litigation, arbitration, and mediation, must be conducted on an exclusively individual basis and not as a class, consolidated, or representative action. By making this express agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as any part of, or on behalf of, any class or any other individuals, before a court or any other tribunal.

Intellectual Property Rights

You expressly acknowledge that all content on the website PTACUnits.com is the exclusive intellectual property of PTACUnits.com, and that all such rights (whether under copyright, trademark, common law, or any other form of intellectual property ownership) are reserved to and by PTACUnits.com alone. You expressly agree not to take any action inconsistent with PTACUnits.com’s intellectual property rights. You also acknowledge that you have been made aware that the trademark “PTACUnits.com” has been or will be registered in the U.S. Patent and Trademark Office by PTACUnits.com.

Use of Your Email

You fully understand and agree that by placing your order or registering a customer account, you consent to PTACUnits.com communicating with you via your email address. You also agree to allow PTACUnits.com to add your name and email address to its customer email list, thereby allowing PTACUnits.com to send you marketing emails highlighting product offerings. You can unsubscribe from this email list at any time. You also understand that your personal information will be handled and treated in accordance with PTACUnits.com’s Privacy Policy.

Damage Exclusion

IN NO EVENT SHALL PTACUnits.COM BE LIABLE TO YOU FOR ANY INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, SPECIAL DAMAGES, PUNITIVE DAMAGES, INDIRECT DAMAGES, LOSS OF PROFITS, LOSS OF REVENUES, OR LOSS OF USE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THESE LIMITATIONS AND EXCLUSIONS WILL APPLY REGARDLESS OF WHETHER LIABILITY ARISES FROM BREACH OF CONTRACT, WARRANTY, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), BY OPERATION OF LAW, OR OTHERWISE.

PRICE MATCH POLICY

PTACUnits.com strives to provide the best possible pricing.  If you find a lower price on an identical item from another authorized dealer please contact a customer service representative.  We will do everything possible to meet or possibly beat that price.  Please have competitor information on hand in writing as you will need to submit that information to us.  This policy does not apply to orders already in process and / or orders that have shipped.  No credit will be issued against prior orders.

PTACUnits.com will not match quotes that are manufacturer direct.  We will also not match closeout, damaged, returned, open box, floor model or display merchandise.  We will not match inside delivery or special needs freight charges.  We will not at any time match prices from web based auction sites.
